Jeremy Peña
Associate

Jeremy Peña is a veteran trial attorney who brings his 20 years of experience helping victims as both a state and federal prosecutor to the civil arena. He prosecuted white collar crimes, fraud, and public corruption for nearly 15 years at the U.S. Attorney’s Office, most recently as the Office’s Senior Litigation Counsel. He joined McGinn Montoya Love Curry & Sievers to team up with the best advocates for injured plaintiffs in New Mexico.
A graduate of the University of Chicago Law School, Pomona College, and the Albuquerque Academy, Jeremy brings the experience of true courtroom practice to each of his cases. He has conducted 45 jury trials, including many cases of community interest. His best-known cases include:
- Jeremy was the lead attorney for the investigation and prosecution of the principals of Ayudando Guardians, which had been the state’s largest guardianship company. He and a team of federal investigators uncovered evidence that Susan Harris, William Harris, Sharon Moore, and Craig Young had systematically stolen millions of dollars from nearly 1000 disabled clients in their care. He coordinated with the Complex Assets Unit of the U.S. Marshals Service to operate Ayudando Guardians following the arrest of the criminals, so that none of the clients would experience an interruption in their housing or other services.
- Jeremy was the lead attorney for the investigation and trial conviction of Solomon Peña (no relation), who organized and carried out a series of shootings against state and local elected officials following his own unsuccessful campaign for the state house of representatives.
- Jeremy was trial counsel in the conviction of Thomas Rodella, the Rio Arriba County Sheriff who improperly detained and abused a series of motorists within his jurisdiction. Jeremy also successfully defended the trial conviction at the Tenth Circuit Court of Appeals.
Over the course of five years at the Second Judicial District Attorney’s Office, Jeremy primarily prosecuted child abuse crimes of all kinds, working with special victims and presenting medical evidence at trial. He approaches each of his cases, civil or criminal, with sensitivity and compassion.
At McGinn Montoya Love Curry & Sievers, Jeremy is delighted to work with attorneys who truly care about their clients, their community, and being a force for positive social change and justice.
